Agreement with Binding Effect

These Terms and Conditions constitute a legally binding agreement ("Agreement") between you and Kumari Job. By accessing or using the Kumari Job website, you agree to these Terms and Conditions. By using Kumarijob.com, you acknowledge that you do so at your own risk. This Agreement shall be governed by the laws of Nepal, and by using Kumari Job and consenting to this Agreement.

Terminology Explained

The following terms are used in this Agreement:

  1. Kumari Job Materials
    This refers to all tools, resources, and plans used by Kumari Job to provide its services. It includes:
    • Tools, kits, and object libraries
    • Any third-party or open-source code used
    • Updates, upgrades, modifications, or improvements to these tools
    • Visual and written content like graphics, images, page layouts, colors, text, and data
    • Features such as Applicant Ranking, Profile Completeness, and Salary Benchmark, and
    • Resumes and other data stored in Kumari Job’s commercial databases

  2. Document

    Any file or content uploaded to the Kumari Job website by either a Job Seeker or an Employer. 

  3. Employer

    Any person or organization using Kumari Job to post job vacancies or search for potential candidates. 

  4. Employer Materials
    All content and materials shared by the Employer, such as:
    • Brochures, emails, job post samples
    • Website content, career fair materials
    • Videos, audio files, images, logos, domain names, and trademarks

  5. Job Seeker

    A person who uses the Kumari Job platform to search for jobs or career-related information (not for hiring purposes).

  6. Services

    All types of help, features, and offerings provided by Kumari Job. 

  7. User

    Anyone who visits or uses the Kumari Job website includes both Employers and Job Seekers.

 

Terms and Conditions for Job Seekers

  1. Site Usage Guidelines

    Kumari Job is created to help individuals find employment opportunities.
    As a job seeker, you are given limited and non-exclusive access to use the Kumari Job website only for personal and non-commercial purposes.

    • You may view and download one copy of the content for personal use.
    • You are fully responsible for any document or content you upload.
    • Kumari Job is not responsible for the consequences of any information you post.
    • Access to the website is a privilege, not a right. Kumari Job may suspend or revoke access at any time, for any reason.

  2. Age and Supervision Requirements
    • You must be at least 13 years old to use the Kumari Job website.
    • If you are under 18 or below the legal age in your country, you must use the website under adult supervision (parent, guardian, or responsible adult).

  3. Permitted Use
    • Do not use the website in ways that are illegal, harmful, or against these terms.
    • You are responsible for making sure your use of the site complies with all applicable laws.

  4. Limitation of Liability

    You are fully responsible for:

    • How you use the Kumari Job website
    • Any content you upload
    • Your actions on and off the website

    • Applicant Ranking: Generated automatically; may not reflect the true competitiveness of candidates.
    • Salary Benchmark: Estimated figures only; may not represent actual salaries in specific industries or roles.

    Additionally:

    • If there is a technical issue (e.g., with email delivery), Kumari Job is not responsible for any disruptions in service.

Terms and Conditions for Employers

  1. Account Authorization

    Kumari Job is allowed to create an account on your behalf only after receiving your verbal or written permission

  2. Website Usage Guidelines

    Kumari Job is built for businesses and employers who want to hire job seekers.
    As an employer, you are given limited, non-exclusive, and temporary access to use the Kumari Job website for internal business purposes only, such as:

    • Searching for and hiring job candidates
    • Viewing and downloading one copy of content solely for recruitment purposes

    You may not sell, transfer, or share your access to services without written permission from Kumari Job.

    You are fully responsible for any materials or content you upload. Kumari Job is not liable for any results or consequences from your postings.

    If you violate any of these terms, Kumari Job can suspend or remove your access at any time.
     

  3. Employer Materials

    When you upload or share materials (like logos, job descriptions, or videos), you confirm that:

    • You own or have permission to use all the content
    • Your materials do not violate any laws or third-party rights (e.g., copyrights, trademarks, privacy laws, or defamation laws)

    By uploading content, you give Kumari Job permission to use your materials (non-exclusively and royalty-free) to provide the services, and to link to your website.

  4. Warranty Disclaimer

    Kumari Job does not guarantee:

    • That its services will help you hire the right candidate
    • That you will fill your vacancies quickly
    • That employees hired through the platform will stay long-term

    Also, Kumari Job is not responsible for any business or hiring decisions you make.

  5. Liability for Damages
    • You are responsible for how you use the site, your materials, and your interactions with others.
    • Kumari Job is not responsible for any data loss, service failure, or damage of any kind.
    • If any issues arise with backend systems (like email delivery problems), Kumari Job will not be held liable.

  6. Limitation of Liability

    Kumari Job and its team (including employees, partners, or agents) are not responsible for:

    • Any indirect losses or damages (like lost profits, lost data, or business interruptions)
    • Issues related to your use or inability to use the site or services

    This applies whether the issue is due to a contract, negligence, or any other legal reason. 

  7. Equitable Remedies

    If you break these terms, Kumari Job has the right to seek both financial compensation and other legal actions (like court orders) to protect its rights.

  8. Conduct Guidelines
    • You may only respond to job seekers for hiring purposes.
    • Do not contact users to promote or sell unrelated business services.
       
  9. Payment and Subscription Terms
    • All payments made to Kumari Job are non-refundable.
    • Your payment gives you access to services for a fixed period only.
    • Payments cannot be transferred to another person or business.

  10. Account Deactivation and Deletion

    • Deactivation: You can choose to deactivate your account at any time. Once deactivated, your profile and all related information will be hidden from the website. You may reactivate your account at any time by logging back in.
    • Deletion: If you choose to delete your account, all associated data will be retained for 7 days in case you change your mind. After this period, all your data will be permanently deleted and cannot be recovered.

 

Security and Confidentiality

We restrict access to your personal information to those personnel who we believe have a legitimate need to know it in order to deliver goods or services to you or to carry out their duties.

To protect your personal information, we have electronic, procedural, and physical measures that stay loyal to Nepali legislation. In order to protect and preserve your privacy, we work to assure adherence to the Information Technology Act's requirements and its resulting regulations. We seek to ensure compliance with the requirements of the Information Technology Act and the Rules made there to ensure the protection and preservation of your privacy.
